Abstract

Justice has undergone a shift in its understanding to a broader and more nuanced concept of justice as it applies to the rights of women. In the modern age, the dynamic nature of the socio-cultural, globalization and the rapid advancements in technology have presented new challenges and opportunities to the realization of the rights of women. This chapter critically evaluates newer aspects of women rights such as cybercrimes, digital inclusion, reproductive autonomy, LGBTQ + rights and the treatment of women within the criminal justice system. It analyses whether the current legal frameworks are sufficient to deal with these problems and identifies structural inequalities that have remained persistent and impede access to justice.

The chapter contends that a transformative approach to justice is inclusive, gender sensitive and responsive to the modern realities by drawing on the international human rights standards and the domestic legal developments. It is culminated with policy recommendations that would enhance legal safeguards and would assure effective access to justice by all women.

Furthermore, it deals with the aspect of cyber-crimes against women and legal challenges faced by them; interconnection of women, Women and technology and digital rights; surrogacy, reproductive rights and legal ethics, followed by LGBTQ+ Women and access to justice as well as women prisoners and human rights.

1. Introduction

The quest to achieve justice to women has been historically influenced by the struggles against the systems of patriarchy, discrimination and exclusion, which are deeply entrenched. Although there have been extensive efforts to transform the status of women through the guarantees of the constitutions, through the legislative measures, and through the international commitments, the process of women rights realization has not proved even and complete. The conventional conceptualization of justice, which gives more emphasis to formal equality before the law, has proved to be not adequate in dealing with the fact that gender-based discrimination is multifaceted and complex.
