1. Introduction

Initially, there was no endorsement for the implementation of the Uniform Civil Code (UCC) due to its varied implications for national unity and integrity. Nonetheless, it is a truth that in our society ruled by the rule of law, gradual progressive reform plays a crucial part in establishing a Uniform Civil Code (UCC). The Preamble of the Constitution asserts that India is going to start beginning. The principles of ‘Secularism’ and ‘Freedom of Religion’ dictate that the State shall not discriminate against any individual based on their religion. The Supreme is a Secular, Democratic, Republic. It should be noted that “There is no state religion”. Article 44 of the Constitution stipulates that there is no connection between religion and personal law. The Court in the case of Sarala Mudgal v. Union of India interpreted the extent of Article 44 of the Constitution of India, which aims to establish a Uniform Civil Code (UCC). It is important to highlight that Article 25 of the Constitution of India guarantees religious freedom; however, courts have frequently asserted that personal matters concerning marriage, succession, and similar secular issues cannot be encompassed within the scope of Articles 25, 26, and 27 of the Indian Constitution.
