Abstract

In his renowned poem ‘Nari’ (Woman), Kazi Nazrul Islam beautifully expressed that everything noble, beautiful, and beneficial in the world is shaped equally by both women and men. Despite this, women’s rights—recognized as fundamental human rights—continue to face numerous challenges across the globe. Law and the justice system play a vital role in safeguarding women from discrimination, violence, and inequality. This paper explores the relationship between legal frameworks, justice delivery, and women’s empowerment, with particular reference to the Indian context. India has established a comprehensive legal structure to protect women’s rights, including legislation addressing domestic violence, workplace harassment, and dowry-related offenses.

However, the effective implementation of these laws remains a major concern. Factors such as social and cultural barriers, lack of awareness, limited access to justice, and institutional inefficiencies hinder the realization of these rights. The paper examines key legislations such as the Protection of Women from Domestic Violence Act (2005) and the Sexual Harassment of Women at Workplace Act (2013), while also highlighting persistent challenges like low conviction rates, judicial delays, and societal pressures that often discourage women from seeking justice. The study concludes that the protection of women’s rights requires a multidimensional approach. Strengthening implementation mechanisms, enhancing legal awareness, and improving access to justice are essential. A collaborative effort involving the government, civil society, and community participation is crucial to reinforce legal systems, ensure accountability, and promote gender equality and women’s empowerment.

1. Introduction

Women’s rights are human rights. Despite progress, women across the world continue to face discrimination, violence, and inequality. Legal frameworks and justice systems are essential tools to safeguard these rights and promote gender equality.

The role and contribution of women in society, the family, and various professional spheres are undeniable; therefore, multiple laws have been enacted under the Indian Constitution to ensure their protection and safeguard their rights.

Despite this, it must be stated that—even in the modern era—ordinary women continue to face deprivation, neglect, and oppression from various quarters within society, the family, and the workplace. Consequently, it stands as a proven truth that laws intended for women’s protection remain confined to a mere handful of women.
